ซึ่งถูกอัยการฝ่ายคดีเศรษฐกิจและทรัพยากร1 ยื่นฟ้องฐานร่วมกันทำรายงานเท็จเพื่อค้ำประกันการกู้เงินกับธนาคาร

เดินทางเข้ารับฟังคำพิพากษาศาลฎีกา วันนี้ (6 ก.ย.)

 

 

ศาลฎีกาพิพากษายืนคำตัดสินของศาลชั้นต้นเมื่อปี 2555 ซึ่งลงโทษจำคุก 20 ปี ไม่รอลงอาญา แก่นายสนธิ ผู้เป็นจำเลยที่ 1

รวมถึง น.ส.ยุพิน และ น.ส.เยาวลักษณ์ ผู้เป็นจำเลยที่ 3 และ 4

ส่วนนายสุรเดช ผู้เป็นจำเลยที่ 2 ถูกลงโทษจำคุก 2 ปี 6 เดือนและไม่ได้ยื่นอุทธรณ์

คดีจึงถือเป็นที่สุดตามกฎหมาย ขณะที่จำเลยอีกสามคนยื่นอุทธรณ์ และศาลอุทธรณ์พิพากษายืนตามศาลชั้นต้นเมื่อเดือน ส.ค. 2557

 

สื่อหลายสำนักรายงานว่านายสนธิและพวกร่วมกันทำรายงานการประชุมเท็จของบริษัท แมเนเจอร์ มีเดีย กรุ๊ป จำกัด ช่วงปี 2539-2540

เพื่อค้ำประกันกู้เงินจากธนาคารกรุงไทย 1,078 ล้านบาท โดยไม่ได้ขออนุมัติจากมติที่ประชุมกรรมการบริษัท

ยอมให้มีการเปลี่ยนแปลงบัญชีซึ่งไม่ตรงกับความเป็นจริง

ไม่ได้นำภาระการค้ำประกันเงินกู้ดังกล่าวส่งให้ตลาดหลักทรัพย์และสำนักงานคณะกรรมการกำกับหลักทรัพย์และตลาดหลักทรัพย์ (กลต.)

เพื่อลวงผู้ถือหุ้นบริษัทแมเนเจอร์ฯ ทำให้ขาดประโยชน์ที่ควรจะได้รับ

ทั้งยังเป็นการลวงให้นักลงทุนในตลาดหลักทรัพย์ไม่ได้รับรู้ถึงการค้ำประกัน หนี้

เข้าข่ายกระทำความผิด พ.ร.บ.หลักทรัพย์และตลาดหลักทรัพย์ พ.ศ.2535
